RNC Legal Action Against Detroit

The Republican National Committee (RNC) has initiated a lawsuit against Detroit’s Department of Elections. Concerns are mounting over the potential erasure of surveillance videos from ballot drop boxes. Allegedly, Detroit deleted footage and violated the Freedom of Information Act (FOIA), which the RNC claims could harm election transparency.

Jonathan Koch and the RNC had requested demand to access insights from the “Absent Voter Ballot Drop Box” placed at Wayne County Community College. The request, citing FOIA, was made in August, motivated by heightened election security concerns during primary elections. The city acknowledged the request but sought an extension for a response.

Detroit’s Response and RNC Objections

On September 16, Detroit officially informed the RNC that the footage had been automatically deleted after 30 days, including recordings from August 7 and 8, initially requested by Koch. The city argued that the delay in responding to the FOIA request contributed to the data being unavailable. The RNC rebuts by asserting that deleting records amid a pending FOIA request directly violates FOIA guidelines.

The RNC emphasizes the broader implications for future elections, accusing Detroit of sidelining election transparency. Michael Whatley, RNC Chairman, condemned these actions as undermining public confidence in elections. The lawsuit aims to enforce compliance with existing transparency laws and prevent similar issues, especially with upcoming national elections.

This legal action is not the first time the RNC has intervened in Detroit’s electoral proceedings. Previously, a lawsuit alleged insufficient hiring of Republican poll workers. Detroit counterclaims, describing such actions as frivolous attempts to erode electoral confidence. RNC’s suit now seeks to ensure compliance with transparency laws, protecting future electoral processes—including the November general election.
